You Can Divorce Your Husband If He Tries to Take Your Property – Rules Court in Pakistan

Pakistan’s Supreme Court has declared that a husband has no right to his wife’s property without her permission – a ruling following a man’s offering of his wife’s land and house to their daughter-in-law, without seeking his wife’s consent.

The judgement by Justice Qazi Faez Isa states that “unless a married woman elects to gift, sell or otherwise dispose of her property neither her husband nor any male relative has any right over it”.

The statement additionally adds that if a man attempts to dispose of his Muslim wife’s property or otherwise prevent ‘her from exercising her legal rights over it’, she would be entitled to terminating her marriage as his actions would be deemed cruel.
